Terms of service

These terms are an agreement between you and Scrappy ("we", "us") covering the Scrappy iPhone app and this website. By downloading or using Scrappy you accept them. If you do not accept them, please do not use the app.

1. Licence

We grant you a personal, non transferable, non exclusive licence to use Scrappy on Apple devices that you own or control, as permitted by the App Store Terms of Service. This licence is subject to Apple's Licensed Application End User Licence Agreement, which applies to Scrappy in full. Where these terms and Apple's standard agreement conflict, Apple's standard agreement takes precedence for the matters it covers.

You may not copy, sell, sublicence, reverse engineer or attempt to extract the source code of the app, except where that restriction is prohibited by law.

2. What Scrappy is, and what it is not

Scrappy helps you spend less time in apps that you have told it to guard. It is a tool for building a habit, and it works by being a friendly obstacle.

Scrappy is not a medical device, a therapy, a diagnosis, or treatment for any condition, including any form of addiction, anxiety or depression. Nothing in the app is medical advice. If your relationship with your phone is causing you real distress, please speak to a qualified professional. Scrappy is a cartoon dog and would be the first to tell you so.

Scrappy is also not a parental control product, a security product or a guaranteed lock. It uses Apple's Screen Time frameworks, which are designed to add friction, not to be unbypassable. A determined person can get past it. That is a deliberate part of the design: you are never truly stuck, and you should not rely on Scrappy to enforce anything where the consequences of failure matter.

3. The removal lock

Scrappy offers an optional removal lock, which ships turned off. When you turn it on, disabling it takes about a day, so that an urge cannot immediately undo a decision you made calmly. You are choosing this delay knowingly when you enable the feature. It never prevents you from deleting the app through iOS itself, and it never affects your legal rights.

4. Free Scrappy

The free version of Scrappy is genuinely free and has no time limit. It includes one complete rule and every safety feature. We may change what the free version includes in future versions of the app, but we will not take away something you have already paid for.

5. Scrappy Pro: subscriptions and purchases

Scrappy Pro unlocks unlimited rules, per app rules, longer walks, weekly reports and full control of the treat economy. It is offered in three forms:

• Scrappy Pro, yearly. 12 months of Pro for $19.99, billed once a year, and including a 7 day free trial for new subscribers.
• Scrappy Pro, monthly. 1 month of Pro for $4.99, billed once a month.
• Scrappy, once forever. A one time purchase of $39.99 that unlocks Pro permanently and does not renew.

Prices are shown in United States dollars and vary by storefront, local taxes and currency. The price that applies to you is always the one shown in the app before you confirm.

How billing works

• Payment is charged to your Apple Account when you confirm the purchase.
• Subscriptions renew automatically unless auto renewal is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period, at the price of the plan you chose.
• You can manage your subscription and turn off auto renewal at any time in your Apple Account settings, under Subscriptions. Deleting the app does not cancel a subscription.
• If a free trial is offered, any unused portion of it is forfeited when you buy a subscription.

Refunds

All purchases are handled by Apple, so refunds are handled by Apple too, under the App Store terms. Request one at reportaproblem.apple.com. We cannot issue refunds directly, though if something has gone wrong we would like to hear about it at [email protected] so we can help or fix it. Nothing here limits any statutory right of cancellation or refund you may have under the law where you live.

6. Acceptable use

Use Scrappy lawfully and on devices you own or control. Do not use it to restrict another adult's phone without their knowledge or consent, and do not attempt to interfere with, disrupt or misuse the app or its extensions.

7. Your data

Scrappy has no account, and your screen time never leaves your phone. Your purchase goes to our subscription provider under an anonymous id, so the app knows you are subscribed. The privacy policy explains exactly what that involves and forms part of these terms.

8. Availability and changes

We may update Scrappy, change features, or stop supporting older versions of iOS. We aim to keep the app working, but we do not promise it will be available without interruption or free of bugs. Scrappy depends on Apple's Screen Time frameworks, and changes Apple makes to those frameworks can affect how the app behaves.

9. Disclaimers

To the fullest extent permitted by law, Scrappy is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non infringement. We do not warrant that Scrappy will block every attempt, that it will produce any particular reduction in your screen time, or that its measurements are accurate.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data, or missed messages, calls, appointments or opportunities arising from an app being blocked. Our total liability for any claim relating to Scrappy is limited to the amount you paid us for it in the 12 months before the claim arose.

Some jurisdictions do not allow the exclusion of certain warranties or liabilities. Where that is the case, the exclusions above apply only to the extent permitted, and nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected.

11. Apple

Apple is not a party to these terms and has no responsibility for Scrappy. Apple has no obligation to provide support or maintenance for the app. If Scrappy fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claim relating to the app, including product liability claims, claims that it fails to conform to a legal requirement, and claims under consumer protection or privacy law. Apple and its subsidiaries are third party beneficiaries of these terms and may enforce them against you.

12. Termination

You can end this agreement at any time by deleting the app, remembering to cancel any subscription separately through Apple. We may suspend or end your licence if you materially breach these terms. Sections that by their nature should survive termination, including disclaimers and limitation of liability, will survive it.

13. Changes to these terms

We may update these terms. If a change is significant, we will update the date at the top of this page and, where it affects your rights in a meaningful way, tell you in the app. Continuing to use Scrappy after a change means you accept the updated terms.

14. Governing law

These terms are governed by the laws of India, and the courts of India have non exclusive jurisdiction over any dispute arising out of them. If you are a consumer, you keep the benefit of any mandatory protections of the law of the country where you live, and you may bring proceedings there.
